中新网台州8月19日电 (记者 李飞云 通讯员 朱利明)浙江台州天台两名男子许一民和卢锋“创新”DB方式，运用网络视频开设境外DB线路。今天，天台法院开庭审理此案，判处俩人1到2年不等的有期徒刑和缓刑，并处罚金。

2006年下半年，许在参与别人组织的“百家乐”DB中输了很多钱以后，心中想何不自己开个DC，一方面自己DB更方便，同时别人参与DB还可以抽头赚钱。方向确定后，他就和潘某(另案处理)对此事进行了商量，并决定“招聘”其表弟卢锋充当投注手，为其洗码。+ |" p/ R% p$ M: x4 H j
5 u$ v4 q% t+ N! K5 q 当年10月份，许联系了表弟卢。两人约定由表弟到境外DC为其做投注手，要求账目做清楚，月工资3000元，做的好的话还有奖励和小费。许的话与正在为没工作发愁的卢一拍即合，两人决定合作一番。

10月底，卢通过偷渡来到了缅甸小勐拉龙腾厅DC。三四天后，许通过转账把10万块钱转到了DC账户，卢用此买了10万的筹码，一个DB网络线路正式投入使用。9 g) @. k( M( n' o1 [' x
# l* u$ g$ z: x. O' _: H" f 周某是许一民通过DC开始赚钱的第一个客户。“开业”第一天，在许的组织下，卢把DC的网址、用户名和密码告诉了周某，随后周某买了10万元的筹码。通过网络视频，周某可看到卢锋为其买的筹码，并指挥卢进行投注。没想到仅几下子，周某就输完了钱。

此后几天，周某几乎每天都拿5万元或10万元左右的钱进行DB，中间有输有赢，但输多赢少。直到一个月后，由于输得太多，周某才收手。

3 G6 A/ L) B0 H+ W9 ^( @ 据检察机关指控，2006年10月到2007年1月间，许一民等人在天台县、宁夏石嘴山等地聚集了10多名参赌人员，让参赌人员通过网络及电话联系等方式加入到许开线的“百家乐”DC中进行下注参赌。卢锋在DC负责进行投注，并和DC按时结算洗码费。如果赌徒赢了，就把钱打进赌徒的账户。就这样，一条境外网络DB的链条形成了。% @' U* S7 M. o" c; \+ a& `% `

许一民的DB生意好时，一天能获得洗码费和返回款4万多元。仅2个月时间就非法获利20余万元。其中许分得5万元，卢分得2万元。

& Z! T+ H% b3 a6 M! c) y 由于“生意”繁忙，许一民等人又安排了2名男子做投注手。再后来，由于个别赌徒在DB“签单”后不肯付钱，许惟恐DC对卢不利，就叫卢悄悄离开了DC回到老家。7 i Z' `3 k8 S( `. X% b
0 K0 ]9 o6 G5 v# R* ^9 G8 U 大约2个月后，也就是在2007年3月到9月份间，已经尝到甜头的许一民又和另一人在该DC开设了网络线路，并雇佣了另一位“码仔”为其提供服务。同时在台州天台县、杭州市等地组织了近10人参与网络DB。大约6个月时间里许等人又获利10余万元，其中许分得5万元。' o* \# j: Y+ F* R9 d% X

案发后，卢在同学聚会时被公安机关抓获，许则投案自首，并退赔了全部非法所得。庭审中，许和卢都表示由于不懂法，才走错了路，今后再也不DB了。

- x) x) R7 W) R- Q& P9 A d 法院认为，许一民和卢锋的行为涉及开设DC罪，遂依法判处许某有期徒刑2年缓刑3年，并处罚金18万元；卢某有期徒刑1年缓刑2年，并处罚金6万元。 |
