信息时报讯 (记者 魏徽徽 通讯员 海法宣) 广州一家私营房产公司收银员利用代收客户缴交购房款、保管退还客户购房款的存折的职务之便，将45万多元一并纳入自己口袋，用于澳门Dubo挥霍。被告人刘蒙逃匿3年被网上通缉落网，昨日下午，在海珠区人民法院以职务侵占罪，领刑5年半罚没5万元。, S* M, [2 u5 }$ ^
代收房款存入自己账户
' s6 H% I( j, a; f! | 据指控，被告人刘蒙曾用名刘俊伟，1979年5月生，广东阳江人，中专文化。2004年8月5日，受聘于广州市珠江湾房地产有限公司财务部，任收银员一职，负责收款、开票、工资核发及数据统计。由于公司人员较少，刘蒙也兼做收取客户预售及房款、开发票等工作。
) u; a, ^$ Y( a 刘蒙说，自己是2006年开始染上Dubo的。2007年3月9日，客户蒋小姐到公司办公室，缴交购买珠江御景湾某房的最后一期房款30万元。当时出纳有事外出，刘蒙便代为收下现金房款27万元，剩下3万元通过银行划账。事后，刘蒙还开出了30万元的发票。
& x6 U2 A9 R8 N# b1 M6 \ 公司得知这笔收入后，特地安排了车送刘蒙到附近农行存现。但次日，财务部负责人却发现刘蒙并没有将27万元存入公司账户，而是存入了刘蒙自己的个人账户。刘蒙当时辩解说，他把钱存在自己的银行账号上，然后再从存折转到公司账上，但后来银行不知为何又将钱退回到他的账号上，只能重新办理。

3月13日，该负责人再次催促刘蒙把上述钱款存入公司账户，但刘蒙迟迟不转。3月15日，刘蒙没有回公司上班，经理打电话给他，他说在广医二院看病，被追问房款后，就将手机关掉了。随后，经理发动公司人员找刘蒙，发现他并没有就诊，再次到刘蒙滨江东路的住处，也没有找到他。
( ]3 f* s, Y! z5 a. h 随后，公司排查刘蒙经手的业务，刘蒙在担任上述职务期间，保管公司用于退还购房者购房款的18本银行存折。发现在同月12日至13日期间，刘蒙竟利用上述职务便利，持上述18本存折，到银行以个人名义将上述存折内的人民币18.68万元全部取出，非法占为己有。该公司遂到公安机关报警。
8 b# h4 w8 J; F3 }+ F9 y 据了解，刘蒙侵占了上述共计45.68万元钱款后，悉数拿到澳门Dubo，全部输光后逃匿。被网络通缉了3年后，刘蒙于2010年11月19日16时许，在江西省南昌市一动漫城被公安人员抓获归案。; r& \% S! h2 b8 h, E
当庭领刑5年半罚没5万
: T- T. U; \/ C1 \ X 昨日庭上，被告人刘蒙对自己侵占公司财产，后携带45.68万元款项去澳门Dubo挥霍一空的犯罪事实供认不讳。由于刘蒙自愿认罪，辩护人亦为其作有罪辩护，法庭决定采用简化审判程序，整个庭审过程仅40分钟左右。刘蒙悔罪称，自己没有能力退回赃款，但希望法院量其认罪态度好，予以从轻处罚，让他有机会尽早出来赚钱退赃。, ^$ v: x! V: A4 T# U' b- a
法院判决认为，刘蒙的行为已构成职务侵占罪，其侵占公司款项共计45.68万元数额巨大，且全部用于Dubo挥霍，案发至今赃款未能缴回，本人及家属亦未能退回赃款，而且在案发后逃避3年多，均属于酌情从重的情节。
9 R$ {0 H# M" n- b 鉴于刘蒙归案后，以及庭审中如实供述犯罪事实，并自愿认罪，可以作为酌情从轻情节考虑。遂依法判处有期徒刑5年6个月，并处没收财产5万元人民币。刘蒙表示回去考虑是否上诉。 |
