马来禁售"大彩"案引天策状告ZF 将转高法审判

本报曾关注并报道的马来西亚吉兰丹州地方ZF查封天策彩票和州ZF禁止出售“大彩”彩票引发的天策不满等系列事件有了新的进展。近日，据马来西亚当地媒体报道，关于该案件已被转交到上级法院审理。

这是一项由三名吉兰丹州商人共同起诉州ZF和哥打巴鲁市ZF的，关于禁止销售“大彩”彩票销售的案件，目前已经由民间高等法院转交到特别权力和上诉法院。三位商人分别是：47岁的黄蒙义、58岁的李凯华和44岁的甘汉川，但是三名原告是否为天策，报道中并未提及。! C: H) @: `; z4 @$ z) r5 }& S

6月6日，在最近一次向法院递交诉讼书中，他们认为，根据联邦宪法，吉兰丹州ZF没有指定、发行或通过任何法律或政策来禁止Dubo或彩票销售活动的权力，其中包括即时刮开票，“大彩”彩票为此类彩票。另外，他们还指出，这些与Dubo或博彩相关的事项以及活动事应根据议会专属管理而执行的。

据了解，在此之前，此案已被民间高等法院公开受理。7月4日，新厄姆法官宣布将此案转移到特别权力和上诉法院。在当地媒体报道中，没有写明前期审理过程的细节和结果。

中华商会会长J.P.Goh得知此事后说：“现任州ZF已经执政20多年，如果出售‘大彩’是违法的，那么早就会打击并取缔了。”达图泰缇联凯尔则表示，彩票销售受联邦法律的保护，联邦法律允许经营和销售彩票。地方ZF无权搜查扣留彩票。没有任何人可以剥夺联邦法律赋予公民的民事权利。 |
