安徽祁门县彩民刘某刮中150万元大奖，后来他应县彩票负责人王某要求，将彩票拿到其办公室以作宣传。没想到，还未来得及兑奖，彩票却落入彩票销售员朱某之手。这起一度闹得沸沸扬扬的“彩票冒领”事件，目前已有了新的进展。祁门县检察院以涉嫌职务侵占罪依法对朱某(女)批准逮捕。

阿健：近年来好像听说过不止一起奖金遭人冒领的事件。- g$ I" D' f8 b) V2 h3 M
宏阳：其实，不止在国内，国外的一些彩票发达国家，比如美国、加拿大、台湾等地都发生过类似的情况。最轰动的恐怕要属台湾2009年7月发生的一起奖金纠纷事件。当时，台湾“威力彩”开出9.2亿元新台币巨奖，但事后高雄市一涂姓商人指原本是自己委托经营彩票站的张姓夫妇代购彩票，没想到中奖后张姓夫妇却领走了奖金，并将税后7亿多奖金存入张太太账户。2 D1 Q5 b- D2 A& R5 [7 z
阿健：为什么冒领者可以领走奖金呢？
/ C" f3 K- z( w 宏阳：这跟目前彩票的一些兑奖机制有关。目前，我国彩票仅限省级(自治区、直辖市)行政区内通兑，并且实行严格的彩票兑奖制度。但需要注意的是，售出的彩票一律不记名、不挂失、不返还本金、不计利息、不流通使用。正是在无记名的情况下，通常彩票持有人被视为大奖得主。冒领者恐怕就是钻了这个空子。0 J3 U* z3 c- i& k& |# M3 B- m
阿健：发生了这种事件后彩民应该怎么办？
! L6 [0 v) u! Y: T( i 宏阳：在对一张中奖彩票归属产生纠纷时，通常依据《财产法》中的个人所属财产来参照，当已证明为个人所属财产并受到侵犯时，公民的合法权益是受到法律保护的，寻求法律解决未尝不是一个好的渠道。那位多伦多便利商店的老板最终因涉嫌偷窃中奖彩票并冒领570万美元奖金，受到了2项欺诈罪和1项偷窃罪指控。而台湾的那对张姓夫妇最终被涂姓商人告上法庭， 当地检方根据电话记录、短信及测谎结果等证据，认定张姓夫妇的确意图私吞奖金。张姓夫妇因此为自己的贪欲付出了2年徒刑的代价。: C# T V9 ^4 v. g' N. y
而在祁门县这起案件中，朱某恐怕免不了坐牢的惩罚。但彩民刘某对自己太不负责了，过分信任他人，同时县彩票负责人王某也有失职地方，因此，提醒广大彩民应该保护好自己的权益，而国内的彩票发行机构也应把好兑奖关，防止此类事情的发生。 |
